Improving litigant choice in debt disputes
Debt disputes in Bombay can be litigated at the Bombay High Court, at the NCLT or at the DRT. Litigants make decisions on whether to sue, where to sue, whether to settle at a given value, etc. How can this decision making be improved?
An article on The Leap Blog by Pavithra Manivannan, Susan Thomas and Bhargavi Zaveri-Shah, on 15 June 2023, offers new evidence towards this problem. They establish a dataset about the three venues, and apply statistical methods that are not contaminated by censorship. They measure the probability of getting to a first hearing in a year, and the probability of the case being disposed in a year for each venue. They also estimate the expected number of hearings in the first year, which helps the litigant project legal expenses.
